Prosecutors have said they plan to seek the death penalty if 31-year-old Nicholas Horner, of Altoona, is convicted of first-degree murder.
Prosecutors say he robbed an Altoona sandwich shop in April 2009, killing a clerk and then gunning down another man a short distance away.
Defense attorneys say his combat-induced post-traumatic stress disorder kept him from forming a legal "intent to kill." During jury selection, defense attorney Thomas Dickey said the law punishes an "evil mind" differently from a "sick mind."
